On 2/9/2021, during the senate Trump impeachment trial, Trump’s lead defense lawyer David Schoen urged the Senate to dismiss as unconstitutional an article of impeachment against Trump. “This trial will tear this country apart, perhaps like we have only seen once before in our history,” Schoen said on the Senate floor.
“Going forward with this impeachment trial of a former president of the United States is unconstitutional…and, as a matter of policy, it is wrong as wrong can be, for all of us as a nation,” Schoen said.
Schoen played a compilation video of Democrats calling for Trump’s impeachment since day one of his presidency.
“A great many Americans see this process for exactly what it is: A chance by a group of partisan politicians seeking to eliminate Donald Trump from the American political scene and seeking to disenfranchise 74 million plus American voters and those who dare to share their political beliefs and vision of America. They hated the results of the 2016 election and want to use this impeachment process to further their political agenda,” he argued.

After the presentation, 44 Republicans sided with Trump’s lawyers and voted that the Senate cannot put on trial a former president, the vote was 56-44. The six Republicans who joined with the Democrats on voting to continue the trial were Sens. Susan Collins of Maine, Bill Cassidy of Louisiana, Lisa Murkowski of Alaska, Mitt Romney of Utah, Ben Sasse of Nebraska and Pat Toomey of Pennsylvania. Cassidy changed his vote from January when he was among the 45 Republicans who supported a motion by Sen. Rand Paul, R-Ky., that declared the trial unconstitutional. Cassidy said he was persuaded by the House impeachment managers’ arguments on Tuesday.

He blasted the House Democratic managers representing the will of the Democratic-run House. ‘What they really want to accomplish here in the name of the Constitution is to bar Donald Trump from ever running for political office again, but this is an affront to the Constitution no matter who they target today,’ he said.
He accused them of harboring an ‘insatiable lust for impeachment.’
Schoen’s remarks sought to blast away the foundation for the trial itself. It came after the other member of his team, Bruce Castor, delivered a rambling 47-minute argument to kick off his defense that the House impeachment was unconstitutional – while saying it would lead to unforeseeable consequences in the future.
