On 8/11/2023, US Attorney General Merrick Garland announced that US Attorney for Delaware David Weiss was appointed Special Counsel in the Hunter Biden investigation. Weiss asked for special counsel status in the Hunter Biden case. “This appointment confirms my commitment to provide Mr. Weiss all the resources he requests,” Garland said. “It also reaffirms that Mr. Weiss has the authority he needs to conduct a thorough investigation and to continue to take the steps he deems appropriate independently based only on the facts and the law.”

Merrick Garland recently said during a press conference that Weiss had full authority to make a decision to prosecute in any district he wanted to. “As I said at the outset, Mr. Weiss was appointed by President Trump as the U.S. Attorney in Delaware and assigned this matter during the previous administration and would be permitted to continue his investigation and to make a decision to prosecute any way in which he wanted to and in any district in which he wanted to,” Garland said in June.
